Privacy Policy

1. Who we are

Whacky Dev is a sole proprietorship based in Pune, Maharashtra, India, that designs and builds web applications. In this policy, "Whacky Dev", "we", "us" and "our" mean the business and its proprietor, who is responsible for the personal data described here.

This policy covers whackydev.com and any enquiry you send us through it or by email. It is published under the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and written with the Digital Personal Data Protection Act, 2023 in mind.

2. Information we collect

Information you give us

When you contact us, through the form or by email, we receive:

• your name and email address;
• your company name, if you choose to give it;
• the type of project you're interested in;
• your message, and anything else you include in your email, such as a phone number or attachments.

Please don't send us passwords, bank or card details, health information, government ID numbers or other sensitive personal data. We don't need any of it to answer an enquiry.

Information collected automatically

• No cookies or tracking. This website does not set cookies and does not use analytics, advertising or tracking tools.
• Session storage. The site stores one value in your browser's session storage so the opening animation only plays once per visit. It contains no personal data, never leaves your browser, and is cleared when you close the tab.
• Fonts. Your browser downloads this site's fonts from Google Fonts (fonts.googleapis.com and fonts.gstatic.com). As part of that request, Google receives your IP address and basic browser information. See Google's Privacy Policy.
• Server logs. Our website hosting provider automatically records technical details of each request, such as IP address, browser type, the page requested and the time. These logs are used to deliver the site and protect it from abuse.

3. How the contact form works

The form on our contact page does not send your details to a server. When you press "Send message", it checks your entries in your browser, then opens your own email app with your message filled in and addressed to hello@whackydev.com. If no email app opens, you can copy the message to your clipboard and send it from any email account.

Nothing reaches us until you send that email yourself. From then on, we handle it like any other email enquiry, as described in this policy.

4. How we use your information

We use the information you send us to:

• reply to your enquiry and answer your questions;
• understand your requirements and prepare a proposal or estimate;
• plan and deliver the work if you become a client, under the terms of our agreement with you;
• keep the records we need for legal, accounting or dispute-resolution purposes.

We do not sell or rent your personal data. We do not use it for advertising, and we won't add you to a mailing list without asking you first. We don't make decisions about you by automated means.

5. Consent

By sending us an enquiry, you consent to us using the details you provide for the purposes in section 4.

You can withdraw your consent at any time by emailing our Grievance Officer. We will then stop using your data and delete it, except for anything we must keep for the legal, accounting or dispute-resolution reasons in section 7. Withdrawing consent doesn't affect anything we did lawfully before you withdrew it.

6. Who we share it with

We share personal data only with service providers that help us run this website and our email, and only as far as each one needs it:

• our email service provider, which stores the emails we send and receive;
• our website hosting provider, which keeps the server logs described in section 2;
• Google, which serves the fonts used on this site.

Some of these providers may store or process data on servers outside India. We may also disclose information where required by law, a court order, or a lawful request from a government authority.

7. How long we keep it

We retain enquiry information for up to 12 months after the enquiry is resolved, unless a longer period is required for legal, accounting, or dispute-resolution purposes.

Server logs are kept by our hosting provider in line with its own retention policy. When we no longer need your information, we delete it.

8. How we protect it

We follow reasonable security practices to protect your personal data from unauthorised access, change or disclosure, and access to enquiry emails is limited to people at Whacky Dev who need it to respond to you.

No website or email system is completely secure, so we can't guarantee absolute security. If we become aware of a breach that affects your personal data, we will inform you and the relevant authorities as required by law.

9. Your rights

You can ask us to:

• confirm whether we hold personal data about you and give you a summary of it;
• correct or update data that is inaccurate or incomplete;
• delete your data, subject to section 7;
• stop using your data, by withdrawing your consent;
• record a nominee who can exercise these rights for you in the event of your death or incapacity.

To make a request, email the Grievance Officer. We may ask you to confirm your identity first, and we aim to respond within one month. If you're not satisfied with our response, you can complain to the Data Protection Board of India.

10. Children

This website is intended for businesses and adults. We don't knowingly collect personal data from anyone under 18. If you believe a child has sent us personal data, contact us and we will delete it.

11. Other websites

This site links to other services, such as our LinkedIn, GitHub and YouTube pages. When you visit them, their own privacy policies apply.

12. Changes to this policy

We may update this policy when our services, tools or legal obligations change. The date at the top of this page shows when it last changed, and significant changes will be highlighted here.
